ALITO'S RIGHT ON ROE

—Hugh Hewitt

"With the release of documents from the Reagan Library files, Judge Samuel Alito's 20-year-old application for a job in the Reagan era Department of Justice has surfaced, and with it his position that there is no constitutional right to an abortion in the Constitution.

This opinion does not tell us how Judge Alito would vote when a case arrives before the Supreme Court that relies on the precedent of Roe and Casey--the two major cases finding a right to abortion in the due process clause of the 14th Amendment. But it does tell us that Judge Alito understood how wrongly decided was Roe, which is very encouraging to everyone who believes the Supreme Court must return to its original and appropriate role.

Not surprisingly, the left is shrieking over Judge Alito's mainstream pronouncement of 20 years ago, and is redoubling its campaign of vilification directed against him."
